1. Acceptance and eligibility
These Terms of Service govern your use of RecoverFlow, operated by PurposeBuilt Capital LLC ("RecoverFlow," "we," "us," or "our"). By using the service, you agree to these Terms. If you use RecoverFlow for a business, you represent that you have authority to bind that business. If you do not agree, do not use the service.
You must be at least 18 and legally able to enter into these Terms. RecoverFlow is intended for authorized business use. Our Privacy Policy describes how we handle information. Acceptance of these Terms is not consent to receive SMS and is not an end consumer's consent to receive a contractor's marketing messages.
2. Business accounts and authorized use
Provide accurate account and workspace information, safeguard credentials, and grant access only to authorized people. You are responsible for activity under your account and for your users' compliance with these Terms. Notify support@recoverflow.co promptly of suspected unauthorized access.
Subject to these Terms, you may use the available RecoverFlow features for your lawful business operations. Features may be limited, under development, or unavailable. Descriptions of planned capabilities do not guarantee availability or a delivery date.
3. Customer and uploaded data
You retain your rights in data you provide. You grant us permission to host, process, transmit, and otherwise use that data only as needed to provide and secure the service, follow your authorized instructions, and meet legal obligations, as described in our Privacy Policy. These Terms do not transfer ownership of your customer data to RecoverFlow.
You are responsible for the accuracy, lawful collection, and authorized use of customer information, spreadsheet contents, estimates, contact details, and outcome records. Review mappings, classifications, draft communications, and reported outcomes before relying on them. Do not upload unnecessary sensitive information or data you are not authorized to provide.
An opportunity or estimate value is not a guarantee of recoverable revenue. A response, booking, or reported outcome does not by itself prove collected revenue or attribution. You remain responsible for your business decisions and supporting records.
4. Acceptable use
Do not use RecoverFlow for unlawful, deceptive, fraudulent, abusive, discriminatory, or infringing activity; unsolicited or unauthorized messages; or content that violates others' rights. Do not evade opt-outs, access another business's data without authorization, share stolen credentials, upload malicious code, disrupt the service, or bypass security, permission, or usage restrictions.
5. Communications responsibilities
Before messaging their customers, business users must obtain legally sufficient authorization for the specific sender, purpose, and messaging program; maintain appropriate consent records; verify contact accuracy; and honor opt-outs and applicable communications laws and provider rules. A phone number in an import, an existing business relationship, or acceptance of these Terms is not automatically sufficient messaging consent.
Use messaging only through features and programs expressly made available and authorized for that purpose. The internal RecoverFlow testing campaign below does not authorize contractor marketing to consumers.
6. SMS Messaging Terms
Brand: RecoverFlow, operated by PurposeBuilt Capital LLC. The current program is internal product-development and quality-assurance SMS testing with consenting RecoverFlow test participants. It is not a third-party consumer marketing campaign.
Participation is voluntary. Participants explicitly opt in to this specific program before being added to the server-side allowlist. Permission for another program, a phone number on file, or allowlisting alone does not constitute opt-in.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help, or email support@recoverflow.co. Carriers are not liable for delayed or undelivered messages.

SMS consent is not a condition of purchasing unrelated RecoverFlow services. Opting out of this SMS program does not prevent use of unrelated services. After opting out, further program messages require a valid new opt-in, apart from any permitted opt-out confirmation.
Our Privacy Policy explains handling of mobile information, SMS content, opt-in data, and consent records, including restrictions on sharing for third-party marketing.
7. Third-party services and availability
RecoverFlow relies on third-party infrastructure such as hosting, database, authentication, email, and messaging providers. Separate terms may apply to third-party services you choose to use. We do not guarantee third-party availability, delivery, or performance.
We may maintain, change, or discontinue features and may experience interruptions or errors. We do not promise uninterrupted service or specific recovery, booking, payment, or revenue results. RecoverFlow is not an emergency communications service.
8. Intellectual property
RecoverFlow and its licensors retain their rights in the software, designs, documentation, branding, and other service materials, excluding your data. You receive only the limited right to use the service under these Terms. Do not copy, resell, or exploit service materials beyond that permission or rights allowed by law.
9. Fees and future billing
Any paid service will be subject to pricing, payment, cancellation, and other billing terms presented and agreed to before purchase. We will disclose applicable fees before charging them. These Terms do not enroll you in a paid plan or authorize charges by themselves.
References to proposed subscription or performance-based pricing do not mean a billing mechanism is operational. Any future performance fee will require separately disclosed and agreed rules for eligible revenue, evidence, attribution, and disputes.
10. Suspension and termination
You may stop using RecoverFlow and contact support to request account closure. We may restrict or suspend access when reasonably necessary to protect security, comply with law, address misuse, or respond to a material breach. We may terminate service for a material breach or discontinue the service with notice where reasonably practicable and required by law.
On termination, your right to use the service ends. Data retention and deletion are subject to our Privacy Policy and applicable obligations. Terms concerning ownership, accrued obligations, disclaimers, liability, and disputes survive as appropriate.
11. Disclaimers
To the extent permitted by law, the service is provided as is and as available, without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that outputs are complete, error-free, or suitable for every business decision. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by law, PurposeBuilt Capital LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost business opportunities, arising from use of or inability to use RecoverFlow.
This limitation does not exclude liability for fraud, willful misconduct, gross negligence, or any liability that applicable law does not permit us to limit. These Terms do not set a separate monetary cap on direct damages.
13. Business indemnification
To the extent permitted by law, your business will indemnify PurposeBuilt Capital LLC against third-party claims and reasonable related costs arising from your unlawful use of the service, customer data that infringes another person's rights, or messages sent without required authorization. This obligation does not apply to the extent a claim results from our own misconduct or breach of these Terms. We will give reasonable notice of a claim and cooperate in its defense; no settlement may impose an admission or non-monetary obligation on us without our consent.
14. Governing law and changes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise. Nothing in these Terms removes mandatory legal protections.
We may update these Terms and will post an updated effective date. For material changes, we will provide reasonable notice where practicable and any notice or consent required by law. If you do not agree to the revised Terms, stop using the service. These Terms do not impose mandatory arbitration or a class-action waiver.
